The fact that the case made international news only sets up more
exposure in terms of federal HIPAA statute. We needn't even identify
Mr. Bertakis by name; the context alone is sufficient to connect him
with the intraoperative details related to thousands of members of ccm-l
and the Trauma-List. For all I know, the original message was sent with
the patient's consent and blessing, along with consent for the various
doctors' statements.
Even if that were not the case, I am confident that no harm was done
here, and wouldn't encourage any consequences. But we should all be
reminded that the cool injuries we chat about have patients attached to
them, and those patients have vigorously protected rights to privacy.
